Umweltanwälte Österreichs – Positionspapier pro Umweltsenat bei Eisenbahn und Autobahn
Der VwGH hat in zwei richtungsweisenden Erkenntnissen festgestellt, dass das nationale UVP-Gesetz bei UVP-Verfahren über Bundesstraßen und Eisenbahn-Hochleistungsstrecken der EU-UVP-Richtlinie nicht entspricht, da nach den erst- und zugleich letztinstanzlichen Entscheidungen der BMVIT keine unabhängige Berufungsinstanz mit umfassenden Prüfungsrechten vorgesehen ist.
