From the perspective of the Environmental Ombudsman, it is not possible to make a final assessment of the project’s impact due to insufficient zoological and botanical surveys. Due to the large-scale sealing of the area, it can be assumed that the impact on the natural balance and habitat will be more than minor. A final assessment of the impact on the protected resources listed in § 1 (1) TNSchG 2005 can only be made after the landscape conservation plan has been submitted.

Status of proceedings: The Regional Administrative Court upheld the complaint lodged by the Environmental Ombudsman, overturned the contested decision, and referred the matter back to the authority concerned for a new decision.
